If you receive IRS Notice CP81, you should take the following steps:

  • Read the notice carefully to understand the amount of the refund that the IRS has applied to your account.
  • If you filed a tax return for the year in question, try to determine why the IRS has no record of it. You may need to contact the IRS to help resolve the issue.
  • If you did not file a tax return for the year in question, you should file one immediately. You can do this online through the IRS website or by mailing a paper tax return to the IRS.

If you do not file a tax return before the statute of limitations expires, you will lose your refund. The statute of limitations for claiming a refund is generally three years after the date the return was due to be filed, or two years after the date the tax was paid, whichever is later.
