IRS Notice CP39 is a notice that the IRS sends to taxpayers to inform them that they have applied a refund owed to their spouse or former spouse towards their past-due tax debt. The notice will usually also advise you how much tax you still owe, if any.
Reasons why it happened:
- You filed a joint tax return with your spouse or former spouse, and they owe back taxes.
- You filed a separate tax return, but your spouse or former spouse owes taxes on a joint return that you filed together in a previous year.
- You are jointly and severally liable for your spouse or former spouse’s tax debt, which means that the IRS can collect the debt from either of you.
- Review the notice carefully to understand the amount of your spouse or former spouse’s refund that was applied to your tax debt and the amount of tax you still owe, if any.
- If you believe that your spouse or former spouse is responsible for your tax debt and that the portion of his or her refund that the IRS applied toward your debt was in error, you can contact the IRS to request an explanation.
- You may also be eligible to file an innocent spouse claim to relieve yourself of liability for your spouse or former spouse’s tax debt.
